Welcome to Puerto Vallarta Tours. By booking or purchasing any of our services through our website https://puertovallarta.tours/, you (hereinafter “The Client”) explicitly agree to the following terms and conditions. Please read them carefully before finalizing your purchase.
1. Bookings, Payments, and Pricing
Booking Process: Your reservation is considered confirmed only upon receipt of the automated email containing your booking reference number and proof of payment.
Data Security: All transactions on our website are protected by high-security SSL encryption protocols. We process payments through certified platforms, such as PayPal, to guarantee the protection of your financial information.
Pricing Policy: Prices are listed in the currency indicated on the website. We reserve the right to modify prices without prior notice; however, the price is locked in and honored once payment has been confirmed.
2. Cancellation and Refund Policy
We understand that travel plans can change. Our policy is flexible, provided the following conditions are met:
Free Cancellation (100% Refund): Applies only if you notify us of your cancellation at least 24 hours prior to your scheduled activity time.
Cancellation Procedure: To cancel, you must call our customer service center at +52 322 399 9927 and provide your booking reference number.
No-Show Policy: If the client fails to appear at the meeting point at the stipulated time and did not cancel 24 hours in advance, 100% of the payment will be forfeited, and there will be no right to a refund or rescheduling.
Weather Conditions: Tours operate in rain or light wind. If conditions are declared dangerous by our staff or the Port Authorities (Capitanía de Puerto), we will offer the option to reschedule the date or time of the tour.
3. Strict Requirements for Drivers and Passengers (ATV & RZR)
For your safety and legal compliance, the following rules apply without exception:
Driver’s License: Every driver must present a Physical and Valid Driver’s License from their country of origin.
IMPORTANT: Digital photos, photocopies, and learner’s permits are NOT accepted. If you fail to present the physical license, you will not be allowed to drive, and no refund will be issued.
Minimum Ages:
ATV: Driver 18+ | Passenger 8+
RZR (Buggy): Driver 18+ | Passenger 6+
Health Restrictions: Pregnant women and individuals with heart conditions, severe back/neck problems, or asthma are not permitted to participate.
Weight Limits:
Single ATV: Max. 110 kg (242 lbs).
Double ATV: Max. 220 kg (484 lbs) combined.
RZR: Max. 400 kg (880 lbs) total vehicle weight.
4. Insurance, Taxes, and Additional Costs
The price paid online covers the reservation of the activity. However, there are mandatory fees that must be settled directly on-site at check-in:
A. Collision Insurance (Mandatory for motorized tours) This insurance is non-refundable and must be paid via credit card in the primary driver’s name.
ATV: $10 USD per unit.
RZR: $20 USD per unit.
Coverage: This payment covers partial damages estimated up to $500 USD. Major damage or total negligence may incur additional costs based on the contract signed on location.
B. Port and Federal Taxes (Water Tours)
Port Tax: Approx. $30 – $60 MXN per person (Cash only).
CONANP Bracelet: Approx. $220 MXN per person (Required for Marietas Islands and protected areas).
5. Transportation and Logistics
No Hotel Pick-up: Our tours do not include transportation to/from your hotel lobby.
Meeting Points: It is the client’s sole responsibility to arrive on time at the designated meeting points (Zona Romántica, Plaza las Glorias, Playa de Oro, or Nuevo Vallarta). The exact location will be sent in your confirmation.
Punctuality: We recommend arriving 15 to 30 minutes prior to departure time to complete the check-in process. The tour departs at the exact scheduled time; arriving late constitutes a “No-Show.”
6. Code of Conduct and Safety
Zero Tolerance (Alcohol & Drugs): Participating under the influence of alcohol or drugs is strictly prohibited. If staff detect this condition, service will be denied immediately without right to a refund.
Compliance with Instructions: Participants must obey all instructions given by the guides. Failure to follow safety rules or reckless behavior will result in immediate cancellation of the tour for the offending client, with no refund.
7. Limitation of Liability
Assumption of Risk: By booking adventure activities, the client acknowledges and assumes the inherent risks involved. Puerto Vallarta Tours is not liable for bodily injury, accidents, or loss of personal property (cameras, phones, glasses, wallets, etc.) during the tour.
Access to “Hidden Beach” (Marietas Islands): Access to the Hidden Beach (Playa del Amor) is subject to tide conditions and the limited capacity established by CONANP. Puerto Vallarta Tours manages the permits but cannot guarantee 100% access, as this depends on federal authorities and natural factors beyond our control.
